Welcome to Driftova! These Terms of Service govern your use of our aquatic facility, services, and website. By becoming a member or using our facilities, you agree to be bound by these terms. If you do not agree with any part of these terms, you may not use our services.
Facility Access and Membership
Membership Requirements
- Members must be at least 16 years old or accompanied by a parent/guardian
- All members must complete a membership application and health questionnaire
- Valid identification and emergency contact information are required
- Payment of membership fees must be current to maintain access
- Members must follow all facility rules and safety guidelines
Membership Types and Fees
- Membership fees are charged monthly in advance
- Fees are non-refundable except as specifically stated in our cancellation policy
- Membership rates may change with 30 days written notice
- Additional fees may apply for personal training and special services
- Late payment fees may be charged for overdue accounts
Facility Rules and Safety
Pool Safety Requirements
- Children under 14 must be supervised by an adult at all times
- Swimming ability assessment may be required for certain areas
- No diving in shallow areas or where prohibited
- Glass containers are strictly prohibited in pool areas
- Appropriate swimwear is required in all pool areas
- Shower before entering pool areas
- Follow all posted signs and lifeguard instructions
Facility Conduct
- Respectful behavior toward staff and other members is required
- No running, roughhousing, or disruptive behavior
- Audio devices must use headphones in shared spaces
- No alcohol or illegal substances on the premises
- Smoking and vaping are prohibited throughout the facility
- Photography and videography require permission
Health and Safety Considerations
Health Disclosures
Members must disclose any health conditions that may affect their ability to safely use aquatic facilities. This includes but is not limited to:
- Heart conditions or cardiovascular issues
- Respiratory conditions that may be affected by pool chemicals
- Infectious diseases or open wounds
- Pregnancy (for participation in certain activities)
- Seizure disorders or other conditions affecting consciousness
Emergency Procedures
- Emergency contact information must be kept current
- Members consent to emergency care if unable to give consent
- Incident reports may be filed for safety-related events
- Emergency evacuations must be followed immediately
Limitation of Liability
By using our facilities, you acknowledge and agree that:
- Aquatic activities involve inherent risks including risk of injury or drowning
- You participate in all activities at your own risk
- Driftova is not liable for injuries resulting from your own actions or negligence
- We maintain appropriate insurance but our liability is limited by law
- You waive claims against Driftova for injuries within the scope of assumed risk
Personal Property
- Driftova is not responsible for lost, stolen, or damaged personal property
- Lockers are provided for member convenience but use is at your own risk
- Valuable items should not be brought to the facility
- Items left overnight may be removed and disposed of
- Lost and found items are held for 30 days before disposal
Membership Cancellation and Suspension
Member-Initiated Cancellation
- 30 days written notice is required for membership cancellation
- Cancellation takes effect at the end of the current billing period
- No refunds for partial months or prepaid fees
- Outstanding balances must be paid before cancellation is processed
Facility-Initiated Suspension or Termination
Driftova reserves the right to suspend or terminate membership for:
- Violation of facility rules or safety guidelines
- Non-payment of membership fees
- Disruptive or inappropriate behavior
- Providing false information on membership applications
- Actions that endanger the safety of others
Privacy and Photography
- Driftova may take photographs or videos for promotional purposes
- Members consent to being included in facility promotional materials
- Personal photography must respect privacy of other members
- Commercial photography requires written permission
- Members may opt out of promotional photography by written request
Intellectual Property
- All content on our website and materials is protected by copyright
- Driftova name and logo are registered trademarks
- Training programs and curricula are proprietary to Driftova
- Unauthorized use of our intellectual property is prohibited
Technology and Website Use
- Website use is subject to our acceptable use policy
- Account information must be kept secure and confidential
- Automated access or data scraping is prohibited
- We reserve the right to modify or discontinue online services
- Technical issues do not excuse non-compliance with membership terms
Force Majeure
Driftova is not liable for failure to perform obligations due to circumstances beyond our reasonable control, including but not limited to:
- Natural disasters or severe weather conditions
- Government orders or public health emergencies
- Equipment failures or utility outages
- Labor disputes or strikes
- Acts of terrorism or civil unrest
Dispute Resolution
- Disputes should first be addressed through direct communication with management
- If resolution cannot be reached, mediation may be required
- These terms are governed by California state law
- Legal proceedings must be brought in Los Angeles County courts
- Class action lawsuits are waived in favor of individual arbitration
Severability
If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Invalid provisions will be replaced with valid provisions that most closely reflect the original intent.
Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be communicated through:
- Posted notices at the facility
- Email notifications to members
- Updates to our website
- Written notices with membership communications
Continued use of our facilities after changes indicates acceptance of new terms.
